1.Introduction
Welcome to the LUMY ecosystem. These Terms of Service (“Terms”) govern your access to the LUMY websites, applications, and services, including participating in the community and node operations (collectively, the “Services”). The Services are provided by Crypto Fellas Corp. (“we”, “us”, or “our”), a Panama foundation company. By accessing or using our Services, you agree to be legally bound by these Terms and our Privacy Policy.
2.Eligibility & Compliance
By using LUMY, you represent and warrant that:
Legal Capacity: You are at least 18 years of age or older.
Prohibited Persons: You are not a “Prohibited Person” (subject to economic sanctions by OFAC, UN, EU, UK, etc.) or located in a Sanctioned Jurisdiction.
Compliance: You are solely responsible for complying with all applicable laws of the jurisdiction you are accessing the Services from.
US Persons: Services involving financial transactions are not offered to U.S. Persons.
No VPN: You will not use a VPN to circumvent geo-blocking or restrictions.
3.Detailed Risk Disclosures (Important)
By using the Services, you explicitly acknowledge and assume the following risks.
Smart Contract & Technology Risk: The Services rely on emerging technologies such as smart contracts. These may contain undetected bugs, vulnerabilities, or errors that could lead to the permanent loss of digital assets.
Blockchain Volatility: Digital assets are subject to extreme market volatility. The value of any assets associated with the LUMY ecosystem may drop to zero.
Regulatory Uncertainty: The regulatory environment for digital assets and blockchain technology is evolving. New laws or government actions may materially restrict or terminate the Services in certain jurisdictions.
Irreversibility of Transactions: Blockchain transactions are irreversible. The Foundation cannot recover assets sent to incorrect addresses or lost due to unauthorized access to your wallet.
Third-Party Risks: You may interact with third-party protocols or oracles. The Foundation is not responsible for the failure, hacking, or insolvency of any third-party providers.
4.Wallet & Asset Responsibility
Finality of Transactions: All blockchain transactions are final and cannot be cancelled or undone.
Security: You are solely responsible for managing your private keys and maintaining the security of your wallet.
5.Prohibited Activities
You shall not engage in the following activities:
Technical Interference: Using bots, hacks, or automation software to modify or disrupt the Services.
Data Mining: Using robots, spiders, or crawlers to scrape or collect data from the Services.
Malicious Code: Introducing viruses, trojan horses, or other technologically harmful materials.
Illegal Use: Accessing the Services in any way not expressly permitted or in violation of applicable laws.
6.Ownership & Feedback
Proprietary Rights: The Foundation owns all right, title, and interest in and to the Services, including text, graphics, and logos.
Feedback: Any suggestions or bug reports (“Feedback”) provided by you become the sole property of the Foundation without compensation to you.
7.Indemnification
7.1 Indemnification: You agree to defend, indemnify, and hold the Foundation Persons harmless from and against any claims, costs, or losses arising out of your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.
7.2 Control of Defense: The Foundation reserves the right to control the defense and settlement of any claim subject to indemnification.
7.3 Third Party Beneficiaries: The Foundation’s affiliates, officers, directors, and agents (“Foundation Persons”) are third-party beneficiaries of these Terms.
8.Disclaimers & Limitation of Liability
“As Is” Basis: The Services are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties.
Liability Cap: To the maximum extent permitted by law, our cumulative liability shall not exceed one hundred US dollars (US$100.00).

9.Dispute Resolution (Arbitration)
Informal Process: You agree to first attempt to resolve disputes informally by contacting support.
Binding Arbitration: Any remaining disputes will be resolved through final and binding individual arbitration.
Class Action Waiver: You waive the right to participate in class actions or representative proceedings.
10.General Provisions
Governing Law: These Terms are governed by the laws of Panama.
Force Majeure: We are not liable for any failure or delay caused by events beyond our control, including acts of God, war, pandemic, or internet connectivity shortages.
Severability: If any provision is found unenforceable, it will be severed, and the remaining terms will remain in effect.
